2. Consumers vs. Distributors

These Terms apply only to individual or business customers (“Consumers”) who purchase directly from the Poma Lifestyle online store. If you are a distributor or reseller, separate distribution agreements apply and override these Terms.

3. Orders & Payment
3.1 Order Confirmation

After placing an order, you’ll receive an email confirming receipt. This confirmation does not constitute final acceptance. We reserve the right to cancel or decline orders at our discretion prior to shipment.

3.2 Pricing & Fees

Prices are listed in your selected currency excluding VAT or GST where applicable. VAT or GST will be added during checkout where applicable and will be shown before you are prompted to complete your purchase. Shipping costs are calculated at checkout based on weight and destination.

3.3 Payment Methods

We accept major credit and debit cards, along with other payment methods as shown during checkout. By submitting payment, you confirm that you are authorized to use the selected method.

3.4 Order Cancellation

Orders may be canceled within 2 hours of placement by contacting support@pomalifestyle.com. After this window, we may have already begun processing, and cancellation may not be possible.

4. Shipping & Delivery
4.1 Shipping Method & Availability

We ship worldwide using FedEx International. If shipping is unavailable to your location at checkout, please contact us via the Contact Us page or through your account so we can facilitate a direct shipment where possible.

4.2 Delivery Timeframes

Orders are typically processed within 5–10 business days. Delivery times vary by location but generally take 2–7 business days after dispatch. You will receive tracking information via email once your order ships.

4.3 Customs, Duties & Import Fees

International orders may be subject to customs duties or taxes imposed by your country. These charges are the buyer’s responsibility and are not included in the purchase or shipping price.

4.4 Risk of Loss

Title and risk of loss pass to you once the package is handed over to the shipping carrier.

5. Returns, Refunds & Warranty

Returns, exchanges, and warranty claims are governed by our Shipping & Returns Policy and Warranty Policy. These policies take precedence over any statements in these Terms.

In brief:

  • Returns for unwanted items are accepted within 30 days, subject to eligibility.
  • Warranty claims are valid for 24 months from the date of purchase.
  • Certain items (e.g., used brush heads, water-damaged devices due to improper charging) are not eligible for return.
6. Intellectual Property
6.1 Ownership

All content on the Site—including text, graphics, logos, product images, and code—is the property of Poma Lifestyle Ltd or its licensors and is protected by intellectual property laws.

6.2 User Feedback

By submitting reviews, ideas, or suggestions, you grant Poma Lifestyle a perpetual, worldwide, royalty-free license to use, modify, and publish that feedback without restriction.

7. Prohibited Conduct

You agree not to:

8. Disclaimers & Limitation of Liability
8.1 Product & Site Disclaimer

The Site and all products are provided “as is” and “as available,” without warranties of any kind unless explicitly stated in our official warranty documentation.

8.2 Limitation of Liability

To the fullest extent permitted by law, Poma Lifestyle’s liability for any claims is limited to the total amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages, except where prohibited by law (e.g., in the EU regarding death or personal injury due to negligence).

9. Governing Law & Dispute Resolution
9.1 Governing Law

These Terms are governed by the laws of Mauritius, unless otherwise required by mandatory local laws (e.g., for EU consumers).

9.2 Arbitration

Disputes shall be resolved via final and binding arbitration under the rules of the Mauritius International Arbitration Centre (MIAC), held in Grand Baie, Mauritius. This does not affect your statutory rights under applicable consumer law.

We reserve the right to update or revise these Terms at any time. Changes take effect upon posting. Your continued use of the Site constitutes your acceptance of the updated Terms.

Limited Warranty Policy (24 Months)

At Poma Lifestyle, we are committed to the quality and reliability of our products. All eligible Poma Lifestyle devices, including the Pomabrush™, are covered by a 24-month limited warranty from the date of original retail purchase. This warranty ensures your product is free from defects in materials and workmanship under normal use.

What the Warranty Covers

If your device experiences a manufacturing defect during the warranty period, we will, at our discretion:

  • Repair the device;
  • Replace it with a new or refurbished unit of equal or greater value;
  • Or refund the purchase price.

The warranty continues from the original purchase date, not the date of replacement.

What the Warranty Does Not Cover

The warranty excludes damage or defects caused by:

  • Misuse, abuse, or improper handling (e.g., charging while wet or submerged);
  • Failure to follow product safety instructions or manuals;
  • Unauthorized repairs or modifications;
  • Normal wear and tear, cosmetic damage, or consumable components (e.g., toothbrush heads);
  • Exposure to liquids unless the product is designed for such conditions;
  • External factors (e.g., power surges, environmental damage).
Eligibility
  • Applies to products purchased directly from Poma Lifestyle or authorized resellers.
  • Valid proof of purchase (receipt or order confirmation) is required for all warranty claims.
  • Registered customers receive expedited service and processing where applicable.
Returns & Refunds Policy
A. Global Returns Policy (Excluding Europe & USA)

We accept returns within 30 days of the original purchase date if:

  • The product is unused, undamaged, and in its original packaging;
  • All original accessories are included;
  • Valid proof of purchase is provided.
Exclusions:
  • Products that have been used or damaged post-delivery;
  • Used toothbrush heads (due to hygiene regulations);
  • Devices damaged by water due to improper charging.
B. EU Consumers: Right to Cancel

As per the EU Consumer Rights Directive:

  • You may cancel your purchase within 14 days of receiving the product for a full refund.
  • The product must be returned within 14 days of notification.
  • Refunds will be issued within 14 days of receiving the returned item or proof of shipment.
C. USA Consumers
  • Returns are accepted within 30 days of purchase for unused and undamaged items in their original packaging.
  • Refunds are processed within 7–14 business days to the original payment method after return is received.
Refund Conditions
  • Shipping fees are non-refundable, where applicable.
  • Promotional items are refunded at the actual purchase price.
  • Refunds for eligible warranty returns will follow the same timeline.
Return Procedure

To initiate a return or warranty claim:

  2. Our team will provide return instructions, including the correct return address based on your location (e.g., USA, EU, or international).
Product Liability & User Responsibilities

By purchasing or using any Poma Lifestyle product, including Pomabrush™, you agree to the following:

1. Assumption of Risk

You understand that electronic personal care products involve inherent risks if misused, including damage or injury from:

  • Charging while wet or submerged;
  • Failure to follow safety instructions;
  • Unauthorized modifications.
2. User Responsibilities
  • Use products only as directed.
  • Follow all manuals, safety notices, and operating instructions.
3. Limitation of Liability

To the fullest extent permitted by applicable law, Poma Lifestyle Ltd and its affiliates are not liable for:

  • Indirect, incidental, special, punitive, or consequential damages;
  • Loss of data, income, or profits;
  • Personal injury or property damage arising from misuse.

In the EU, this limitation does not exclude liability for death or personal injury caused by negligence or willful misconduct as prohibited by law.

4. Indemnification

You agree to indemnify and hold Poma Lifestyle Ltd harmless from any claims or damages resulting from the misuse or unauthorized use of the product.

Governing Law & Jurisdiction
  • EU Consumers: Governed by the laws of the country of residence, in accordance with EU Regulation (EC) No 593/2008 (Rome I).
  • USA Consumers: Governed by the laws of the State of Delaware, USA.
  • All Other Regions: Governed by the laws of Mauritius, unless otherwise stated.

We ship worldwide using FedEx International.

  • Shipping costs are calculated at checkout based on the weight and destination of your order.
  • If shipping is not available to your location at checkout, please contact us via the Contact Us page or through your customer account. We will assist you directly to facilitate a shipment.
1.3 Estimated Delivery Time

Once shipped, orders generally arrive within 3–8 business days, depending on your region and FedEx delivery standards.

1.4 Customs & Duties

International orders may be subject to customs fees, taxes, or import duties imposed by local authorities. Poma Lifestyle has already included these charges in our shipping fees, so that you can receive your delivery without any issue or holdup.

2. Returns & Warranty

Our returns and warranty policy is designed to be fair, clear, and consistent with global consumer protection standards.

2.1 Returns – Change of Mind

If you change your mind, you may return eligible products within 30 days of the original purchase date, provided they are:

  • Unused and undamaged
  • In their original packaging
  • Accompanied by proof of purchase

Return shipping costs for unwanted items are the customer’s responsibility.

Exceptions (Non-Returnable Items):

  • Used or opened items
  • Toothbrush heads (for hygiene reasons)
  • Devices showing water damage due to improper charging
2.2 Returns – Defective Products (Warranty Coverage)

All Poma Lifestyle devices are covered by a 24-month limited warranty from the date of purchase.

If your product is confirmed to be defective due to a manufacturing issue:

  • We will repair, replace, or refund the product at our discretion.
  • We will cover return shipping costs for warranty-approved defects.
